The Political Director for the outgoing prime minister Viktor Orbán of Hungary, Balázs Orbán, has posted a lengthy message on his Facebook page about the recent ruling by the Court of Justice of the European Union (CJEU) on Hungary’s 2021 Child Protection Act, which deemed it violates EU law.
‘One of Fidesz’s most important decisions was the passage of the 2021 Child Protection Act, which simultaneously curbed the dissemination of gender propaganda in the media and advertising, took action against paedophile offenders, and drew a clear line in the area of school education. The law stated that there is no place for ideological campaigns in sex education, especially during early childhood. Education and the media must not become testing grounds,’ Director Orbán writes.
The Child Protection Act was passed by the National Assembly of Hungary in June 2021.
‘The crux of the debate lies in the fact that, under the guise of education and raising awareness, educational institutions are presenting content that critics describe as gender propaganda—a practice similar to that seen in many Western European countries. The fundamental rationale behind the Hungarian regulations is that the protection of minors takes precedence: there is a widespread social conviction that children should not be confronted with issues concerning identity and sexual development at the most sensitive age, nor within an institutional setting, when they are still particularly impressionable in physical, emotional, and psychosexual terms,’ Orbán goes on to write in his social media post.
He also accuses Brussels of, with this decision, making modern gender ideology a core value of the Union. The writer argues that they did so by referring to Article 2 of the Treaty on European Union, which states that the EU is ‘founded on the values of respect for human dignity, freedom, democracy, equality, the rule of law and respect for human rights, including the rights of persons belonging to minorities.’
Therefore, Orbán argues, this ruling means that modern gender ideology cannot legally be constrained in any of the EU Member States, regardless of the majority opinion on the issue of gender in the country.
‘We are now entering a phase in which they want to tell Member States that...they must comply—whether they like it or not. Legal arbitrariness, blackmail, and open coercion—this is the brave new world that has arrived. We decide whether to accept it or change it. This case also highlights that patriots are needed now more than ever,’ Director Orbán declares.
