Jenő Szmodis

Jenő Szmodis is associate professor at the National University of Public Service (Budapest). He graduated from the Faculty of Law and Political Science of Miskolc University in 1993. He has worked as a legal counsellor and an attorney and has occupied various positions in public service as a legal expert and leader. His PhD study deals with questions concerning the philosophy of law (2009). In 2016 he obtained habilitation in multidisciplinary legal studies. He has published more than one hundred and twenty articles, as well as studies and five books on cultural issues, philosophy of history and the cultural and multidisciplinary contexts of the great legal systems of the world.

‘State of the Union’ — Some Critical Thoughts on the Relationship Between EU Law and the Hungarian Legal System

It is hardly an exaggeration to say that the Court of Justice of the European Union created the principle of primacy of EU law from scratch. Although nowadays the mainstream considers this idea unchallengeable, the task of the constitutional courts is precisely to promote the development of a healthy balance by strengthening the principle of constitutional identity. By finding a balance, the tension between the legal systems of the Member States and EU law might also become reconcilable.
