Anthony Fauci, who was the US government’s primary medical expert as the Director of the National Institute of Allergy and Infectious Diseases during the COVID-19 pandemic, testified before the United States Congress in Washington, DC, on Wednesday, 28 July.
His testimony sparked the ire of Republican lawmakers—not because of its content, but the lack of it.
Dr Fauci answered virtually every question posed to him by reading the pre-written statement, ‘On the advice of counsel, I respectfully decline to answer based upon my rights under the Fifth Amendment of the Constitution’.
He gave this answer 111 times total during his testimony before Congress.
Anthony Fauci did so when Senator Rand Paul pressed him on whether he was aware, as evidence in communication with his colleague suggested, that the SARS-CoV-2 virus causing the COVID-19 pandemic likely originated in a laboratory, at a time he was publicly dismissing that theory. Senator Paul also wanted to know if the doctor’s Institute had funded gain-of-function research in Chinese labs where the virus likely originated.

Dr Fauci also came up with the same ‘canned’ response even when Senator Josh Hawley of Missouri asked him what day of the week it was or what colour of tie he was wearing…
What might be even more troublesome for the doctor is that—as Senator Hawley pointed out during the hearing—he might not even have those Fifth Amendment rights he was so eagerly appealing. Right before leaving office, President Biden gave him a blanket pardon for any potentially criminal acts he may have committed related to his service as a public health official from 2014 until issuing the pardon in January 2024.
Thus, with self-incrimination no longer a threat, Dr Fauci should not be able to appeal to the Fifth Amendment, as ruled by the US Supreme Court in their 1896 decision Brown vs Walker.
Can Dr Fauci Go to Jail?
His cynical testimony before Congress may not go unpunished for 85-year-old Dr Fauci.
Republican lawmakers are accusing him of contempt of Congress, a federal crime, although just a misdemeanour.
Thus, people being incarcerated for this charge is rare—but not unprecedented.
Steve Bannon, one of the closest advisors to President Trump during his first presidential campaign and first term in office, served four months in jail between July and October 2024. He was convicted of contempt of Congress in July 2022 for refusing to fulfil a congressional subpoena and testify before the January 6 House Select Committee.
